Felony Conspiracy to Distribute Controlled Substance (Cocaine) Federal Court- Eight defendant conspiracy case. Trial lasted six weeks, if convicted defendant would have been a mandatory minimum of 10 years in prison. My client was the only one acquitted of the charges. Felony Federal Credit Card Fraud- 11 defendants- Case dismissed! Felony 1st Degree Arson- Hennepin County- Case completely dismissed by Judge on pretrial motion to Judge for lack of probable cause. Felony Negligent Fire/Arson- Hennepin County- Case completely dismissed by Judge following a pretrial Florence hearing. Felony 1st Degree Criminal Sexual Assault- Ramsey County- All criminal sexual conduct charges dismissed day of trial and a negotiated plea to 5th degree simple assault and no jail time. Criminal Sexual Conduct (rape)- University of Minnesota discipline hearing. Client was accused of sexually assaulting a resident of his dorm. Following investigation by the University it was decided that client would be suspended from the University of Minnesota and lose his full-ride scholarship to the Carlson School of Business. I was brought in to defend the client against these accusations before a 5-person panel of University personnel one week prior to the trial. Client was found not responsible by the panel 5-0. He was allowed to stay at the U of M, kept his scholarship and as a result of this victory no criminal charges were brought. White Collar- Felony Embezzlement- Washington County- Defendant embezzled over $50K from her employer. Case resolved with a Gross misdemeanor sentence and no in custody jail. White Collar- Felony Embezzlement- Anoka County- Defendant embezzled over $50K from employer. Defendant received probation, no in custody jail and the matter will be reduced to a misdemeanor at the end of probation. White Collar- Felony Theft of Public funds-Sherburne County- Defendant stole over $250K from employer, a public utility. Defendant received probation rather than prison. White Collar- Felony Theft of Public Funds- Hennepin County- Defendant stole over $100k from employer, a public entity. Defendant received probation. Felony Domestic Assault by strangulation- Hennepin County- Case was negotiated such that defendant's charges were reduced to misdemeanor assault and no in custody jail. Felony DWI/DUI and Driving after Cancellation- Dakota County- The Judge was convinced to give Defendant a staggered sentence, wherein defendant would serve 60 days each year, however, if defendant followed the rules of probation, remained law abiding, and completed treatment and remained sober he could bring a motion to forgive his jail time each year. 1st motion has been granted and jail forgiven. Felony possession of Controlled Substance- Hennepin County- Charges completely dismissed by Judge following a pretrial Rasmussen hearing. Three separate cases of Felony Theft over $2,500 and $35K- Hennepin County- Negotiated settlement of one continued for dismissal in one year; other two probation with a reduction to misdemeanor after probation is over. 30 days of EHM (electric home monitoring) and 30 days STS (sentence to service/ community service). Felony Possession of Controlled Substance- Nicolett County- Defendant had 17 lbs of marijuana delivered to his home. Negotiated Settlement of a stay of adjudication (case dismissed in 3 years when probation is complete) and no executed jail. Felony Possession of Child pornography- Hennepin County- Negotiated settlement of continuance for dismissal after one year. Case was dismissed. Felony Possession of Child pornography- Hennepin County- Negotiated settlement of continuance for dismissal after one year. I was asked to consult on this case with another attorney based on previous success in this area. Investigation of Felony Child pornography- Hennepin and Anoka- Charges declined by prosecutor. Felony 2nd Degree Assault, Assault with a deadly weapon- Hennepin County- Convinced prosecutor to not charge client after six months of counseling and anger management. Felony Criminal Vehicular Operations- Hennepin County- Blood test suppressed after a pre-trial Rasmussen Hearing, charges dismissed. Felony Criminal Vehicular Operations- Hennepin County- Negotiated settlement to reduce charge to a gross misdemeanor. Staggered sentence that resulted in no executed in-custody jail. Felony 1st Degree Armed Robbery and Kidnapping- Hennepin county- This was a presumptive prison case, convinced Judge to do probation with some local workhouse time. Felony 3rd Degree Criminal Sexual Conduct (Juvenile Court)- Dakota County- Stay of Adjudication, case dismissed after 6 months of treatment. Felony 3rd Degree Criminal Sexual Conduct (Juvenile Court)- McLeod County, Stay of Adjudication, case dismissed after 6 months of treatment. Felony 3rd Degree Criminal Sexual Conduct- Anoka County- Case negotiated with no jail; Stay of Imposition so after probation is complete the conviction will be non-felony. Felony Depravation of Parental rights- Washington County, Stay of Adjudication, case dismissed after probation complete. Felony Wrongfully obtaining Public Assistance or unemployment- various counties- Negotiation of diversion program resulting in a dismissal. Felony Residential Burglary- Hennepin and Ramsey county- Negotiation of diversion program resulting in a dismissal. Felony Check Forgery- Hennepin County- Case dismissed on motion of Prosecutor when I convinced him he had charged the wrong person. Other cases negotiated with diversion program resulting in ultimate dismissal of charges. Forgery of a Prescription- Hennepin County- Negotiated with a diversion program resulting in an ultimate dismissal of charges. Felony Credit Card Fraud- Hennepin, Ramsey, and Anoka County- Negotiated with a diversion program resulting in an ultimate dismissal of charges. Felony Counterfeit Gambling Chips-Scott County- Negotiated settlement of a gross misdemeanor and no jail. Felony Theft of a controlled substance, possession of a controlled substance by a county employee from jail-Hennepin county- Negotiated settlement of Stay of Imposition and no jail. Conviction will be non-felony when probation is complete. Felony Terroristic Threats- Anoka County- Negotiated settlement of Stay of Imposition and no in-custody jail. Conviction will be non-felony when off of probation. Felony Juvenile matters- various counties- Negotiations of cases that result in no conviction either by agreement of prosecutor or judgment of the court. Numerous Felony State and Federal investigations- Charges declined by prosecutor. Indecent exposure- Hennepin County- Negotiated settlement of continuance for dismissal resulting in ultimate dismissal of charges. 2nd Degree DWI/DUI- Scott County- Following a pretrial Rasmussen hearing the blood test was suppressed leaving the State with no evidence to pursue the charges. Scott County appealed to the Court of Appeals, district court ruling was affirmed on appeal (we won appeal). All charges dismissed against client. 4th DWI/DUI degree- Hennepin County- Dismissed by Judge following a pretrial Rasmussen Hearing. Implied consent revocation of defendant's license was also dismissed. Harassment and Staking- Dakota County- Case dismissed by Judge following pretrial Rasmussen hearing. Violation school bus arm- Trial, Defendant acquitted. Numerous other cases negotiated with a continuance for dismissal resulting in an ultimate dismissal of charges.
